Welcome to ProBull! These Terms of Service ("Terms") govern your use of our messaging services, known as ProBull Messaging ("Service"), provided by ProBull ("we," "our," "us"). By accessing or using our Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
2. Eligibility
You must be at least 18 years old to use ProBull Messaging. By using our Service, you represent and warrant that you meet this age requirement.
3. Description of Service
ProBull Messaging enables users to receive email and SMS communications related to their interactions with ProBull, including appointment reminders and other pertinent information.
4. User Responsibilities
You agree to use ProBull Messaging in accordance with all applicable laws and regulations. You are responsible for maintaining the confidentiality of any account information and ensuring that your contact information is accurate and up to date.
5. Messaging Services
Users can expect the following regarding our messaging services:
- Appointment Reminders: Users can expect to receive email and SMS messages for appointment reminders.
- Canceling SMS Service: You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
- Support and Assistance: If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to [email protected] or call us at (435) 292-3688.
- Message Delivery: Carriers are not liable for delayed or undelivered messages.
- Message and Data Rates: As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.
- Privacy Inquiries: For privacy-related inquiries, please refer to our Privacy Policy.
6. Fees and Charges
Using ProBull Messaging may incur charges from your mobile carrier or email provider. You are responsible for any fees or charges associated with your use of our Service.
7. Limitation of Liability
To the fullest extent permitted by law, ProBull shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service;
- Any unauthorized access to or use of our systems and/or your personal information.
8. Termination
We reserve the right to terminate or suspend your access to ProBull Messaging at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of our Service, us, or any other party.
9. Changes to Terms
ProBull reserves the right to modify these Terms at any time. We will notify you of any significant changes by updating the "Effective Date" at the top of these Terms. Your continued use of ProBull Messaging after any changes constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which ProBull operates, without regard to its conflict of law provisions.
